Functions
|
- Provides legal opinions and counsel to the Manager, Managers of CH business lines and other principal staff. Provides legal opinions and counsel to management of other field elements, as assigned, with respect to intellectual property law.
- Provides legal advice and counsel to Managers of CH business lines, contracting officers and program managers in assuring CH program requirements are met, including environmental health and safety, ethics, intellectual property, personnel, procurement, and real estate.
- Provides assistance to Contracting Officers and program/project managers in negotiation and administration of performance-based management and operating contracts, commercial contracts, financial assistance agreements, and interagency agreements.
- Provides legal review for Managers of CH business lines, including contracting officers, of acquisition, assistance, interagency agreements, real estate and other transactions for which the Manager has been delegated authority.
- Provides assistance to contracting officers and program/project managers by reviewing and negotiating intellectual property rights provisions in acquisition and assistance instruments, intra-agency agreements, subcontracts, nondisclosure agreements, and licenses for CH, other field elements, as assigned, and performance-based management and operating contractors, and assuring that program requirements are met.
- Administers the intellectual property rights provisions in Department acquisition and assistance instruments, intra-agency agreements and subcontracts including, but not limited to clearance of contractual instruments, certifications of class waiver standards, and all aspects of invention prosecution practice before the U.S. and foreign patent offices.
- Assists program managers (field and headquarters) in promoting effective technology transfer of concepts and data developed by Government employees and under Department acquisition and assistance instruments and subcontracts.
- Takes appropriate legal action to protect the interests of DOE in litigation and administrative proceedings in which CH has an interest. Represents DOE in administrative hearings including EEOC, and MSPB hearings.
- Reviews or approves for legal entitlement, all claims by or against the Government in which CH has an interest.
- Represents the Manager in legal relationships with others.
- Ensures that activities are conducted in accordance with applicable DOE Orders and other regulations, including, but not limited to, environmental protection, operational health and safety.
- Administers the CH Freedom of Information, Privacy Act, and Technical Information Programs.
- Administers the CH ethics program including review of OGE Form 450 and providing ethics training.
